You, the Police and your legal rights! The firearm laws of some states require that motorists traveling through the
state with a handgun place the handgun unloaded and in open and plain view, while a few other states require that any handguns
be placed in open and plain view, but leave the choice as to whether or not the weapon is loaded to the motorist.
Some states allow the traveler to carry a handgun in the glove box or console, loaded or unloaded, and a few others allow
persons to carry handguns concealed or open, if secured in a holster and worn on the belt. The statutory laws and regulations
of every state are different and the language of the law can be very confusing, therefore the motorist traveling with a handgun
must always be cautious!
If you choose to transport a handgun in open and plain view in your vehicle and you are
stopped by a police officer for a traffic violation, you should assume that the handgun most assuredly will attract the attention
of the officer during the traffic stop.
If the officer observes a handgun in your vehicle, it may cause him to
become concerned of his own safety and could warrant such actions by the officer as to the drawing of his weapon, ordering
you out of your vehicle and performing a "pat-down" search of your person and any passengers of the vehicle. You
should be knowledgeable of the proper procedures to follow during a traffic stop which might be the result of a moving vehicle
violation, particularly if you have a handgun in your vehicle. This means, any handgun carried openly and in plain view on
or about your person, or hidden from common observation within the interior of the vehicle.
The term hidden from
common observation has been ruled by the courts to mean a handgun which is easily accessible to any occupant within a vehicle.
This includes the glove compartment, console, door panel storage areas, under the seat, and in other areas within the interior
of the vehicle which is easily accessible to any occupant of a vehicle.

details only) Q: What are the laws in the State of Alabama relating to the transportation of a handgun in a motor vehicle?
A: Alabama law, Section 13A-11-73 prohibits any person from carrying a pistol in any vehicle or concealed on or about
his person without an Alabama concealed weapon license or other recognized permit.
Q: Are city and county firearm
regulations & ordinances consistent with Alabama state laws? A: Firearm laws statewide are uniform. This state prohibits
localities from enacting firearm-related ordinances.
Q: How can I lawfully travel through the State of Alabama
with my handgun and stay out of trouble with the authorities? A: According to the Office of the Attorney General of
the State of Alabama, a motorist can travel through the state under the protection of United States Code of Law -18 USC §
926A, The Gun Control Act of 1968. Extended stops for reasons other than vehicle fueling or emergency services could possibly
weaken the defense that the traveler was transporting a firearm under the guidelines of the United States Code of Law -18
USC § 926A, and could possibly cause the traveler to be subject to the effect of the laws of the State of Alabama.
Q: Will the State of Alabama honor my out-of-state concealed weapons permit or license? A: Alabama gives legal
recognition to concealed weapon permits or licenses issued to persons 21 years of age or older by the following states: Alaska,
Colorado, Florida, Georgia, Idaho,Indiana, Kentucky, Michigan, Mississippi, New Hampshire, North Carolina, North Dakota, Oklahoma,
Tennessee, Utah and Wyoming.
Q: If the State of Alabama does not honor concealed weapon permits or licenses from
my state, and I am arrested and charged with a violation of Alabama’s concealed carry laws, what are the penalties?
A: A person who carries concealed about his person, a Bowie knife or knife or instrument of like kind or description
or a pistol or firearm of any other kind or an air gun shall, on conviction, be fined not less than $50.00 nor more than $500.00,
and may also be imprisoned in the county jail or sentenced to hard labor for the county for not more than six months. Alabama
